1. Acceptance of Terms

These Terms govern your use of Bitcoin Podcast Summarizer at btcpods.xyz (the "Service"), operated by Jamie Selects, LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Bitcoin Podcast Summarizer is a free web application that delivers AI-generated summaries of Bitcoin-focused podcasts to registered subscribers via email. The Service is provided free of charge. Optional Bitcoin payments are accepted but never required to access any feature of the Service.

3. User Accounts

To receive email summaries, you must create an account using a valid email address and password. You are responsible for:

• Providing accurate and truthful account information
• Maintaining the confidentiality of your password
• All activity that occurs under your account

You must be at least 13 years old to create an account. You may only maintain one account per person.

Please notify us immediately if you believe your account has been compromised.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure
• Systematically scrape, crawl, or extract data from the Service in a way that disrupts normal operations
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Submit RSS feed URLs that contain malicious, deceptive, or harmful content
• Use automated means to create accounts or interact with the Service at scale
• Interfere with the integrity or performance of the Service

We reserve the right to suspend or terminate your account at our discretion for violation of these rules.

5. AI-Generated Content — No Financial Advice

Summaries delivered by the Service are generated by an artificial intelligence model (Anthropic Claude Haiku) based on publicly available podcast transcripts. They are provided for informational and entertainment purposes only.

Nothing in any summary constitutes financial, investment, legal, or tax advice. Bitcoin and other digital assets are highly volatile. Any discussion of prices, market signals, or investment strategies in a summary reflects what was said by the podcast host and does not represent our views, opinions, or recommendations. You should always conduct your own independent research before making any financial decision.

6. Third-Party Podcast Content

Podcast audio, transcripts, artwork, and other content are the intellectual property of their respective creators, hosts, and publishers. Bitcoin Podcast Summarizer does not claim ownership of any podcast content. AI-generated summaries are transformative works intended to help listeners decide what to listen to; they are not substitutes for the original episodes.

We are not affiliated with any of the featured podcast creators unless explicitly stated.

7. Optional Bitcoin Payments

Bitcoin payments made via the Lightning Network or on-chain are entirely voluntary unless required to unlock a paid tier you choose to purchase. They do not confer any additional rights, features, service guarantees, or priority access beyond what is described for that tier.

Bitcoin transactions are irreversible. All payments are final. We are unable to issue refunds for Bitcoin payments under any circumstances.

By making a payment, you represent that you have the legal right to use the funds being paid and that the payment complies with all applicable laws in your jurisdiction.

8. Service Availability

We aim to provide reliable service but make no guarantees of uptime, availability, or uninterrupted access. The Service may be interrupted due to maintenance, third-party service failures, or circumstances outside our control.

Email delivery depends on third-party providers (currently Resend). Occasional delivery failures, delays, filtering by spam systems, or bounce events may occur and are outside our direct control.

9. Intellectual Property

The Bitcoin Podcast Summarizer application code, branding, design, and original written content (excluding third-party podcast content and AI-generated summaries) are owned by us or our licensors. You may not reproduce, distribute, or create derivative works from our original content without our prior written permission.

AI-generated summary text produced by the Service is made available for your personal, non-commercial use. You may share individual summaries with appropriate attribution to Bitcoin Podcast Summarizer.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT SUMMARIES ARE ACCURATE, COMPLETE, CURRENT, OR FREE FROM ERRORS. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE AT ANY PARTICULAR TIME.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless Jamie Selects, LLC and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or in any way connected to your use of the Service or your violation of these Terms.

13. Termination

You may delete your account at any time. We may suspend or terminate your account at our discretion, including if you violate these Terms or if we discontinue the Service. Upon termination, your subscription preferences and email history will be deleted in accordance with our Privacy Policy.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state courts located in Sacramento County, California, and the federal courts located in the Eastern District of California.

15. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
